By accessing our website, making a booking, completing a payment, or participating in any activity, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.
1. General
Elephant Junction Thekkady ("Elephant Junction", "we", "our", or "us") offers tourism and recreational activities including but not limited to:
- Elephant interaction programs
- Elephant feeding experiences
- Elephant bathing experiences
- Plantation tours
- Jeep safari experiences
- Cultural and educational activities
- Guided experiences
- Other tourism-related activities offered at our premises
These Terms apply to all users, visitors, customers, and participants.
2. Bookings
2.1 Online Reservations
- Bookings may be made through our official website or authorized booking channels.
- A booking is considered confirmed only upon successful payment and issuance of a booking confirmation.
- Customers are responsible for providing accurate personal and contact information.
- Elephant Junction reserves the right to refuse, reject, or cancel bookings that contain inaccurate, incomplete, or misleading information.
2.2 Availability
- All bookings are subject to availability.
- Activity schedules may be modified due to operational requirements, weather conditions, safety concerns, government regulations, or animal welfare considerations.
2.3 Age Restrictions
- Certain activities may have minimum age, height, weight, or health requirements.
- Children must remain under the supervision of a parent or legal guardian at all times.
3. Payments
3.1 Payment Gateway
- Online payments are securely processed through Razorpay and other approved payment providers.
- By making a payment, customers also agree to comply with the terms and policies of the respective payment provider.
3.2 Pricing
- All prices displayed on the website are in Indian Rupees (INR).
- Applicable taxes shall be charged as required by law.
- Prices may change without prior notice; however, confirmed bookings shall not be affected.
3.3 Failed Transactions
- If payment is deducted but no booking confirmation is received, customers should contact Elephant Junction immediately with transaction details.
- Confirmation of booking is subject to verification of payment.
3.4 Payment Gateway Charges
- Payment gateway fees, transaction charges, convenience fees, or similar charges imposed by third-party payment processors may be non-refundable.
- Where legally permissible, such charges may be deducted from any approved refund.
3.5 Chargebacks and Payment Disputes
- Customers agree to contact Elephant Junction first to resolve payment disputes before initiating a chargeback.
- Fraudulent or unjustified chargebacks may result in cancellation of bookings and restriction of future bookings.
- Elephant Junction reserves the right to provide transaction records, attendance records, communication logs, and booking details to payment processors, banks, or legal authorities during dispute investigations.
4. Cancellation and Refund Policy
4.1 Customer Cancellation
- Cancellation requests made more than 48 hours before the scheduled activity may be eligible for a refund of up to 90% of the booking amount.
- Cancellation requests made between 24 and 48 hours before the scheduled activity may be eligible for a refund of up to 50% of the booking amount.
- No refunds shall be issued for cancellations made within 24 hours of the scheduled activity.
- No refunds shall be provided for no-shows.
4.2 Cancellation by Elephant Junction
Elephant Junction may cancel or reschedule activities due to:
- Severe weather conditions
- Government restrictions
- Animal health or welfare requirements
- Safety concerns
- Operational emergencies
- Force majeure events
In such cases, customers may be offered:
- Rescheduling to another available date, or
- A full refund of the booking amount paid.
4.3 Refund Processing
- Approved refunds shall be processed to the original payment method used for booking.
- Refunds may take between 7 and 10 business days to reflect, depending on banks, payment processors, or card issuers.
- Elephant Junction shall not be responsible for delays caused by financial institutions or payment gateways.
5. Promotions, Coupons and Gift Vouchers
5.1 Promotional Offers
- Promotional offers, coupons, discount codes, and special packages may be subject to separate terms and conditions.
- Promotional discounts may not be combined unless specifically stated.
- Discounts have no cash value and cannot be exchanged for cash.
- Elephant Junction reserves the right to modify or discontinue promotional offers at any time.
5.2 Gift Vouchers
- Gift vouchers and gift cards are non-refundable and non-transferable unless otherwise specified.
- Gift vouchers must be redeemed within their validity period.
- Expired vouchers shall not be extended or refunded unless required by law.
6. Arrival and Participation
6.1 Arrival Policy
- Visitors should arrive at least 30 minutes prior to the scheduled activity time.
- Valid identification and booking confirmation may be required.
- Late arrivals may lose their booking slot without refund.
6.2 Missed Activities and No-Shows
- Customers who fail to attend their scheduled activity shall be treated as no-shows.
- No refunds, credits, or rescheduling shall be provided for no-shows.
- Exceptions may be granted solely at the discretion of Elephant Junction.
7. Visitor Conduct
Visitors agree to:
- Follow all instructions provided by staff, guides, trainers, and mahouts.
- Respect animals and avoid behavior that may disturb or endanger them.
- Conduct themselves responsibly and respectfully.
- Avoid consuming alcohol, narcotics, or intoxicating substances before or during participation.
- Wear appropriate clothing and footwear.
Elephant Junction reserves the right to deny participation or remove any visitor whose behavior is considered unsafe, disruptive, abusive, or harmful.
8. Health and Safety
Visitors participate at their own risk.
Participants should disclose any medical conditions that may affect their ability to safely participate.
Individuals who are pregnant or who have mobility limitations, heart conditions, recent injuries, or serious medical conditions should consult a medical professional before participating.
Failure to disclose relevant medical information may result in denial of participation without refund.
9. Weather and Animal Welfare
9.1 Weather Conditions
Many activities occur outdoors and may be affected by:
- Rain
- Flooding
- Storms
- Wildlife movement
- Other environmental factors
Activities may be delayed, modified, shortened, or cancelled for safety reasons.
9.2 Animal Welfare Policy
The welfare of elephants and other animals remains a top priority.
Activities may be modified, restricted, postponed, or cancelled when necessary to protect the health, safety, wellbeing, or comfort of any animal.
Such decisions are final and made solely in the interest of animal welfare.
10. Assumption of Risk
Participation in tourism and outdoor activities involves inherent risks.
By participating, visitors acknowledge and voluntarily accept risks associated with:
- Animal interactions
- Outdoor environments
- Uneven terrain
- Weather conditions
- Transportation used during activities
- Other reasonably foreseeable risks
Participation is entirely voluntary.
11. Limitation of Liability
To the maximum extent permitted by law:
- Elephant Junction shall not be liable for personal injury, illness, accidents, loss, theft, or damage to personal property arising from participation in activities.
- Elephant Junction's total liability shall not exceed the amount paid for the relevant booking.
Nothing in these Terms excludes liability where such exclusion is prohibited by applicable law.
12. Photography, Videography and Drones
12.1 Personal Photography
Visitors may take photographs and videos for personal use unless otherwise instructed.
12.2 Commercial Photography
Commercial photography, videography, filming, live streaming, or media production requires prior written approval from Elephant Junction.
12.3 Drone Usage
Drone operations are strictly prohibited without prior written authorization and all required governmental approvals.
12.4 Promotional Use
Photographs and videos captured during activities may be used by Elephant Junction for marketing, advertising, social media, website content, and promotional materials.
Visitors who do not wish to appear in promotional materials must notify Elephant Junction in writing before participating.
13. Electronic Tickets and Booking Confirmations
- Booking confirmations, QR codes, reservation references, and e-tickets are valid only for the specified date, time, and activity.
- Bookings are non-transferable unless approved in writing.
- Any attempt to duplicate, alter, misuse, or resell booking confirmations may result in cancellation without refund.
14. Intellectual Property
All content on this website, including:
- Logos
- Trademarks
- Images
- Videos
- Text
- Graphics
- Designs
are the property of Elephant Junction or its licensors and may not be reproduced, distributed, or used without prior written permission.
15. Privacy and Data Security
15.1 Personal Information
Personal information collected through the website shall be handled in accordance with our Privacy Policy.
15.2 Payment Information
Payment transactions are processed through secure third-party payment providers including Razorpay.
Elephant Junction does not store complete:
- Credit card numbers
- Debit card numbers
- UPI PINs
- Net banking credentials
- CVV numbers
Customers are responsible for safeguarding their payment credentials.
16. Force Majeure
Elephant Junction shall not be liable for delays, interruptions, modifications, or cancellations caused by circumstances beyond its reasonable control, including:
- Natural disasters
- Floods
- Landslides
- Pandemics
- Epidemics
- Government actions
- Civil unrest
- Strikes
- Transportation disruptions
- Utility failures
- Acts of God
17. Dispute Resolution
Customers are encouraged to contact Elephant Junction directly regarding complaints, refunds, booking concerns, or disputes before pursuing formal legal action.
Elephant Junction will make reasonable efforts to resolve disputes amicably and promptly.
18. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of India.
Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Idukki District, Kerala, India.
19. Amendments
Elephant Junction reserves the right to update, amend, modify, or replace these Terms and Conditions at any time.
Changes become effective immediately upon publication on the website unless otherwise specified.
Continued use of the website or services constitutes acceptance of the updated Terms.
